General Terms and Conditions (GTC)
1. Scope of application
1.1 These General Terms and Conditions apply to all contracts for the temporary rental of apartments, rooms and premises by Cozy Cologne Rentals, represented by Mr. Serhat Solmaz, to guests.
1.2 Deviating or conflicting terms and conditions of the customer shall not apply unless Cozy Cologne Rentals has expressly agreed to their validity in writing.
1.3 If the customer books services not only for himself, but also for employees, accompanying persons or other third parties, he is obliged to ensure that these persons also comply with these GTC.
2. Conclusion of contract
2.1 The contract is concluded by the booking confirmation from Cozy Cologne Rentals or by the provision of the booked service.
2.2 If a booking is made via online portals, this may be made dependent on the provision of a valid credit card or advance payment.
2.3 If the booking confirmation deviates from the content of the inquiry, the content of the booking confirmation shall be deemed binding unless the customer objects immediately.
2.4 If a third party has booked on behalf of the customer, this third party shall be jointly and severally liable with the customer for all obligations arising from the accommodation contract.
3. Arrival, stay and departure
3.1 Access to the accommodation is usually gained independently via key boxes (self-check-in). The access data required for this and all necessary information for check-in are usually sent to guests by email or message 1-2 days before arrival.
3.2 Unless otherwise agreed, check-in is possible from 15:00 on the day of arrival.
3.3 On the day of departure, the apartment must be vacated by 11:00 a.m. at the latest.
3.4 In the event of late departure, Cozy Cologne Rentals may charge additional costs:
until 13:00: up to 50 % of the daily price
after 13:00: full daily price
4. Services and prices
4.1 The information on the website
www.cozycologne.com
and the information in the booking confirmation are decisive for the contractual services.
4.2 All prices include the statutory taxes applicable at the time of booking.
4.3 Local taxes (e.g. municipal accommodation taxes) are to be borne by the guest, insofar as these are prescribed by law.
4.4 Cozy Cologne Rentals offers parking facilities depending on the location. Availability and costs may vary depending on the property and will be communicated to the guest during the booking process or upon request.
5. Use of the accommodation
5.1 The subletting or re-letting of the accommodation provided is not permitted.
5.2 Structural changes or interventions in the facility are not permitted.
5.3 Smoking is prohibited inside the apartments and in the communal areas.
5.4 The guest is obliged to comply with the statutory registration regulations.
5.5 No additional electrical appliances that are not part of the equipment may be operated in the apartments.
5.6 The maximum number of persons stated in the booking may not be exceeded. Additional visitors or overnight guests are only permitted with the prior consent of Cozy Cologne Rentals.
5.7 Parties, events or larger gatherings are generally not permitted in the apartments. Guests undertake to respect the statutory quiet periods and the interests of neighbors and other residents.
5.8 The accommodation must be treated with care and left in a proper condition. Cozy Cologne Rentals reserves the right to charge an additional cleaning fee in the event of exceptional soiling that goes beyond the usual scope of a final cleaning.
5.9 The guest undertakes to handle the keys or access systems provided with care. In the event of loss or damage, the costs of replacement or exchange may be charged.
6. Pets
6.1 Pets are generally allowed, but must be registered prior to arrival.
6.2 One pet is permitted per booking.
6.3 A fee of €20 per night is charged for each additional pet.
6.4 The guest is liable for all damage or soiling caused by pets.
7. Video surveillance
For the safety of guests, employees and property, Cozy Cologne Rentals operates video surveillance in publicly accessible areas (e.g. entrance area, corridors, stairwell, elevator and parking lot).
Naturally, there is no surveillance within apartments or sanitary areas.
The recordings are used exclusively for security purposes and are deleted after an appropriate period of time.
8. Payment
8.1 The total price of the booking must always be paid before arrival.
8.2 Depending on the booking system, payment can be made by credit card, PayPal or other payment methods offered.
8.3 Cozy Cologne Rentals is entitled to demand an advance payment or security deposit.
9 Cancellation conditions
9.1 Bookings can be canceled free of charge up to 5 days before arrival. In this case, 100% of the amount paid will be refunded.
9.2 Cancellations less than 5 days before arrival are no longer possible free of charge.
9.3 In the event of a no-show, Cozy Cologne Rentals reserves the right to reallocate the booked apartment. No refund will be made in this case.
9.4 In the event of early departure, there is no entitlement to a refund for unused overnight stays.
10. Premature termination of contract
Cozy Cologne Rentals is entitled to terminate the accommodation contract without notice if:
these GTC are violated,
the house rules are violated,
the accommodation is used inappropriately,
incorrect information was provided at the time of booking,
other guests, neighbors or employees are significantly disturbed.
In this case, there is no entitlement to a refund of payments already made.
11. Liability
11.1 Cozy Cologne Rentals is only liable for damages caused by intentional or grossly negligent behavior.
11.2 The guest is liable for all damage caused by him/herself or by persons traveling with him/her.
11.3 No liability is accepted for lost or damaged items belonging to the guest.
11.4 Forgotten items will only be forwarded on request and against reimbursement of the shipping costs.
12. Internet use (WLAN)
Use of the WLAN access provided is at the guest’s own risk.
The guest undertakes not to use the Internet access for illegal activities, in particular not for copyright infringements, illegal downloads, the distribution of illegal content or other criminal acts.
Should the use of Internet access by the guest result in legal infringements or claims by third parties, the guest shall be solely liable for all resulting consequences, costs, claims for damages and any legal costs.
13. Final provisions
13.1 The law of the Federal Republic of Germany shall apply.
13.2 The place of jurisdiction is – as far as legally permissible – the registered office of Cozy Cologne Rentals.
13.3 Should individual provisions of these GTC be or become invalid, the validity of the remaining provisions shall remain unaffected.
